ברוך הבא לאתר צחי כהן – מורה דרך (להלן: “האתר").
השימוש באתר כפוף לתנאים ולהוראות המפורטים להלן. אנא קרא אותם בעיון. עצם השימוש באתר מהווה את הסכמתך לכל התנאים.
1. כללי
1.1 האתר מופעל ומנוהל על ידי צחי כהן, מורה דרך מוסמך (להלן: "המפעיל").
1.2 האתר משמש כאתר מידע ושירותי הדרכה בנושאי תיירות, טיולים, סיורים קולינריים ותרבותיים, בארץ ובחו"ל.
1.3 השימוש באתר מיועד לגולשים מעל גיל 18 בלבד.
1.4 המפעיל רשאי לעדכן, לשנות או להסיר חלקים מהאתר או מהתקנון בכל עת וללא הודעה מוקדמת.
2. שימוש באתר
2.1 השימוש בתכני האתר הוא אישי ובלתי מסחרי בלבד.
2.2 המשתמש מתחייב שלא להשתמש באתר לשום מטרה בלתי חוקית, מסחרית או כזו העלולה לפגוע בצדדים שלישיים.
2.3 המפעיל שומר לעצמו את הזכות לחסום גישה למשתמשים אשר יפרו תנאים אלו.
3. זכויות יוצרים וקניין רוחני
3.1 כל הזכויות באתר ובתכניו (לרבות טקסטים, תמונות, עיצוב, לוגו, קבצי וידאו ותוכן הדרכה) שייכות למפעיל בלבד או לצדדים שלישיים שהרשו את השימוש בהם.
3.2 אין להעתיק, להפיץ, לשכפל, לפרסם או להשתמש בתוכן האתר, כולו או חלקו, ללא קבלת אישור מראש ובכתב מהמפעיל.
3.3 כל הפרה של זכויות יוצרים תיחשב עוולה אזרחית על פי חוק.
3.4 באתר עשויות להופיע פרסומות שמקורן בחברות ו/או עסקים שאינם בבעלות ו/או באחריות בעל האתר. אין לבעל האתר כל אחריות בנוגע לתוכן פרסומות אלו. אם נתקלתם בפרסומת פוגענית ו/או פרסומת אשר מפרה את החוק אנא פנו אל בעלי האתר בכתובת office@tours-il.com בבקשה להסרת הפרסומת.
4. אחריות ושיפוי
4.1 התוכן באתר ניתן לצרכי מידע בלבד. המפעיל יעשה כל מאמץ להציג מידע מדויק, אך אינו נושא באחריות לכל טעות, השמטה או שינוי.
4.2 המפעיל אינו אחראי לכל נזק ישיר או עקיף שייגרם למשתמש או לצד שלישי עקב השימוש באתר.
4.3 המשתמש מתחייב לשפות את המפעיל בגין כל נזק, הוצאה או תביעה שייגרמו עקב הפרת תנאי תקנון זה.
4.4 האתר מאוחסן בשרת אשר מאובטח על ידי חברה חיצונית. בעל האתר אינם אחראים לנזק אשר יגרם כתוצאה מפריצה חיצונית לאתר – בין היתר – הפצת/מכירת מידע כתוצאה מפריצה לאתר, שיבוש במידע, פגיעה בזכויות יוצרים או קניין רוחני אחר, או כל נזק אחר שיגרם כתוצאה מחבלה באתר ובתכניו.
5. קישורים לאתרים חיצוניים
5.1 האתר עשוי להכיל קישורים (links) לאתרים של צדדים שלישיים.
5.2 אין למפעיל שליטה על תוכן האתרים הללו ואינו נושא באחריות כלשהי לגביהם. השימוש באתרים אלה הוא באחריות המשתמש בלבד.
6. פרטיות המשתמשים
6.1 המפעיל מכבד את פרטיות המשתמשים ופועל בהתאם להוראות חוק הגנת הפרטיות, התשמ"א-1981.
6.2 פרטים אישיים שיימסרו באתר (שם, טלפון, דוא"ל, העדפות סיור וכו’) יישמרו במאגר מאובטח ויעשה בהם שימוש לצורך:
• יצירת קשר עם הפונה
• התאמת שירותים ותוכן
• שליחת עדכונים ומידע (בהסכמת המשתמש בלבד)
6.3 האתר עושה שימוש בעוגיות (cookies) ובכלים אנליטיים כגון Google Analytics לצורך שיפור חוויית הגלישה.
6.4 ניתן לחסום או למחוק cookies בהגדרות הדפדפן, אך ייתכן שחלק מהפונקציות באתר לא יעבדו כראוי.
6.5 המשתמש רשאי לעיין במידע עליו, לבקש את תיקונו או מחיקתו – באמצעות פנייה לדוא"ל: info@tours-il.com.
6.6 המפעיל מתחייב שלא להעביר מידע אישי לצדדים שלישיים, אלא אם ניתנה לכך הסכמת המשתמש או נדרשת לכך חובה חוקית.
7. איסור פגיעה באתר –
7.1 אין לבצע כל פעולה באופן ישיר או על ידי צד ג’, אשר עשויה לפגוע באתר, בזמינות הגלישה שבו, או בתוכן המוצג בו, או לשבש את פעולתו. אין לעשות שימוש בקוד תוכנה או כל פעולה אלקטרונית/דיגיטלית ו/או אוטומטית אחרת כגון וירוס ו/או ‘תולעת’ ו/או ‘בוט’ למטרת פגיעה כאמור באתר.
7.2 למשתמש ו/או לצד ג’ אסור לבצע כל פעולה אשר נועדה לעשות שימוש בתכני האתר למטרה מסחרית ו/או כל מטרה אחרת. בסעיף זה ‘תכני האתר’ – תכני טקסט, פרטים אישיים של המשתמשים, מידע סטטיסטי אודות פעילות המשתמשים, קוד תוכנה.
8. שינויים ועדכונים
המפעיל רשאי לשנות תקנון זה או את מדיניות הפרטיות מעת לעת.
הגרסה המעודכנת תפורסם באתר ותיכנס לתוקף במועד פרסומה.
9. דין וסמכות שיפוט
הדין החל על תקנון זה הוא הדין הישראלי בלבד.
לבתי המשפט המוסמכים בעיר תל אביב תהיה הסמכות הבלעדית לדון בכל מחלוקת הנוגעת לשימוש באתר.
